These Website Terms of Use ("Terms") are an agreement between you and Freedom Products LLC, doing business as ShipSquared ("ShipSquared," "we," "our," or "us"), a Texas limited liability company. They govern your use of shipsquared.com, our forms, tools, calculators, content, and any communications you have with us through this site.
1. Acceptance
By accessing or using this website, submitting a form, requesting a quote, or downloading a resource, you agree to these Terms and to our Privacy Policy . If you do not agree, do not use the site.

This site is intended for businesses. You must be at least 18 years old and able to form a binding contract. If you use the site on behalf of a company, you represent that you have authority to bind that company to these Terms, and "you" means both you and that company.
3. These Terms Are Not Your Service Agreement
Our fulfillment, warehousing, freight, sourcing, and software services are provided only under an Order Form signed by ShipSquared and Client, which incorporates the ShipSquared Fulfillment Terms . Nothing on this website creates a service relationship, reserves capacity, or obligates either of us to do business.
If you have a signed Order Form with us, your Order Form and the Fulfillment Terms control for that engagement and take precedence over these Terms wherever they conflict.
4. Website Content, Quotes, and Estimates
Content on this site, including pricing pages, cost calculators, scorecards, savings estimates, benchmarks, case studies, blog posts, and performance statistics, is provided for general information and marketing purposes. It is based on assumptions, historical averages, and information you provide, and it is not a quote, offer, guarantee, or projection of results. Actual rates, timelines, savings, and outcomes depend on your products, volumes, destinations, carriers, seasonality, and the terms of a signed agreement.
Any rate, estimate, or quote we give you is non-binding until confirmed in a signed Order Form, and remains subject to carrier pricing, fuel and accessorial charges, duties, tariffs, and capacity. We may change site content, pricing information, and service descriptions at any time without notice.

6. Your Submissions and Our Communications
You are responsible for the accuracy of what you submit and you must have the right to share it. Do not send us sensitive personal data, health information, payment card numbers, or confidential third-party information through website forms.
When you submit a form, you consent to be contacted by ShipSquared and our authorized representatives by phone, text message, messaging apps, and email, including with automated dialing or messaging technology, and to receive marketing and sales communications, and you agree we may use your information for advertising audiences as described in our Privacy Policy . Consent is not a condition of purchase. Message and data rates may apply. Reply STOP to opt out of texts or use the unsubscribe link in any marketing email.
If you send us ideas, feedback, or suggestions, you grant us a perpetual, worldwide, royalty-free license to use them without obligation or compensation to you.
7. Intellectual Property
The site and its content, including text, copy, graphics, logos, the ShipSquared name and marks, software, layouts, images, video, and data compilations, are owned by ShipSquared or our licensors and are protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to view and use the site for your own internal business evaluation. You may not copy, republish, resell, frame, or create derivative works from our content without our prior written permission. Third-party brand names and logos shown on the site are the property of their owners and are used to identify platforms, carriers, or clients.
8. Third-Party Sites and Services
The site links to and integrates with third-party platforms, marketplaces, carriers, and tools we do not control. We are not responsible for their availability, content, terms, pricing, or acts and omissions. Your use of them is governed by their own terms.
9. Referral and Affiliate Programs
If you participate in a ShipSquared referral, affiliate, or partner program, additional program terms apply. Commissions and referral payments are earned only on qualified, closed, and paid business, are subject to verification and clawback for refunds, chargebacks, or non-payment, and require the referral to be submitted before we have an existing relationship or open opportunity with that brand. We may modify or end a program at any time.
10. Disclaimer of Warranties
THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY CONTENT, ESTIMATE, OR STATISTIC IS ACCURATE OR COMPLETE. YOUR USE OF THE SITE IS AT YOUR OWN RISK.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHIPSQUARED AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, LOST REVENUE, LOST SALES, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO YOUR USE OF THIS WEBSITE, EVEN IF WE WERE ADVISED OF THE POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO YOUR USE OF THIS WEBSITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). THIS SECTION DOES NOT APPLY TO LIABILITY UNDER AN ORDER FORM AND THE FULFILLMENT TERMS, WHICH HAVE THEIR OWN LIABILITY TERMS, AND DOES NOT LIMIT LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.
12. Indemnification
You agree to defend, indemnify, and hold harmless ShipSquared and its owners, officers, employees, and agents from any claims, damages, liabilities, costs, and reasonable attorneys' fees arising out of your use of the site, your submissions, or your breach of these Terms or of applicable law.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws rules. Any dispute arising out of or relating to these Terms or your use of this website will be resolved by binding arbitration administered in the State of Texas under the Commercial Arbitration Rules of the American Arbitration Association, and judgment on the award may be entered in any court of competent jurisdiction. Either party may seek injunctive relief in a Texas court to protect intellectual property or confidential information.
Disputes will be arbitrated individually. You and ShipSquared each waive any right to a jury trial and to participate in a class, collective, or representative action. You agree to bring any claim within one (1) year after it arises, to the extent permitted by law.
14. Changes to These Terms
We may update these Terms at any time. We will revise the "Last updated" date above and post the current version on this page. Your continued use of the site after an update means you accept the revised Terms.
15. General
If any provision of these Terms is held unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding this website. We are independent contractors, nothing here creates a partnership, joint venture, employment, or agency relationship.
